A measure passed by Kentucky lawmakers this year to restrict the sale of vaping products has been upheld by a judge.
Franklin Circuit Judge Thomas Wingate Monday dismissed a lawsuit claiming the new law was unconstitutional. He says the action by lawmakers amounted to a “legitimate state interest.”
Under the measure, vaping products not granted authorization by the Food and Drug Administration would be kept out of Kentucky stores.
Supporters say it's an effort to reduce youth vaping. They say it would have no impact on FDA-authorized products or those that come under the FDA’s safe harbor rules.
The law takes effect at the start of 2025.
