Judge Rules Beshear Can Remain in Pension Lawsuit

A Kentucky judge has denied a motion filed by Gov. Matt Bevin to disqualify attorney general Andy Beshear from a pension reform lawsuit.  
 
Bevin filed the motion because he says Beshear disqualified himself when he gave legal advice to legislators before suing them on the same subject matter.  
 
An attorney on behalf of Beshear argued that he was acting within his legal capacity.  
 
The Franklin Circuit Court judge says because there is a sense of urgency in the case, he denied the motion, saying Beshear acted "ethically."  
 
Beshear filed the lawsuit, arguing the pension law violated the state constitution.  
 
The law will move new teacher hires into a hybrid plan that puts less risk on the state but doesn't guarantee them the same benefits.  
 
Beshear released a statement saying: Today's ruling recognizes that, as the attorney general, I’m the people’s lawyer, and. . . I will continue to protect the rights of our public servants and to enforce the Constitution’s requirement that our government is transparent and never turns a sewage bill into a pension bill ever again.
