Rape, Sodomy Trial for Soldiers Set for October

A trial date has been set for four Kentucky National Guard soldiers accused of sexual crimes in the summer of 2017.

According to the Calloway County Circuit Court Clerk, Judge James Jameson set a trial date of October 16 for Anthony R. Tubolino, Tyler A. Hart, Austin L. Dennis, and Jacob F. Ruth. A pretrial conference has been set for September 3.

A trial had initially been set for May, but it was pushed back due to a scheduling conflict. 

The men, who are all from south central Kentucky, were in Calloway County for National Guard exercises when the alleged crimes took place. 

Kentucky State Police say the victim reported a sexual assault on June 3, 2017. Investigation led police to believe the men gave alcohol to the woman, who was under 21 years old, and then sexually assaulted her. The men were arrested eleven days later. 

Tubolino faces charges of first-degree rape, first-degree sodomy and unlawful transaction with a minor. Hart faces charges of first-degree sodomy and first-degree sexual abuse. Dennis and Ruth both face a charge of first-degree sodomy.
