A thirteen year old has been charged with fourth degree assault in connection to an incident Sunday evening on the playground of a local elementary school.
The youth was charged through the local Court Designated Workers Office and was issued a date to appear in juvenile court.
The incident involves a twelve-year-old boy who told police that he and two friends were playing on the playground at Morgan Elementary School when another youth approached and punched him several times in the face. Officer Nicholas Francescon reported that the victim had visible cuts on his face, but the boys mother was present at the time the officer took the report, and declined medical treatment.
The victim told Francescon that he knows the other boy only by a nickname.
On Sunday evening, the victim began complaining of nausea and a headache. His mother took him to Lourdes hospital for treatment, but he was later transferred to a Nashville hospital for observation.
Kentucky law states that fourth-degree assault is committed with an intention to cause physical injury. Charges may be amended to second-degree assault if it is determined that the intent of the action was to cause serious physical injury.
